Terms of Service

Welcome to Dialo. By accessing or using our services, you agree to these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By creating an account, purchasing credits, or using Dialo's services, you agree to be bound by these Terms and our Privacy Policy. If you disagree, please do not use the service.

2. Service Description

Dialo provides browser-based voice calling globally, subject to availability and applicable laws. Features may change over time. We may suspend or limit the service to protect users, maintain platform integrity, or comply with law.

3. Lawful Use & Prohibited Activities

You agree to use Dialo only for lawful purposes and to comply with all applicable telecom, anti-spam, consumer protection, and privacy laws. The following are strictly prohibited and may result in immediate suspension and forfeiture of remaining credits:

  • Illegal activities, harassment, fraud, or impersonation
  • Scam, robocalling, or mass-dial operations (including auto-dialers)
  • Infringing, harmful, or abusive content or behavior
  • Attempts to bypass rate limits, abuse promotions, or interfere with the service

We may investigate suspected misuse and cooperate with law enforcement where required.

4. Accounts & Security

You're responsible for the accuracy of your account information and for maintaining the confidentiality of your login. All activity under your account is your responsibility. Notify us immediately of any unauthorized use.

5. Credits, Billing & Payments

  • Pay-as-you-go: Calls are charged per minute (or partial minute) at the rates posted in our Pricing section.
  • Prepaid credits: You must have sufficient credits to place calls. Unused credits are non-refundable unless required by law.
  • Rate changes: We may update rates at any time; new rates apply to future calls.
  • Taxes & fees: You are responsible for any applicable taxes or regulatory fees.
  • Chargebacks: Fraudulent or unwarranted chargebacks may lead to account suspension.

Payments are processed by trusted third-party providers. Dialo does not store your full payment details.

6. Subscriptions (If Offered)

Some features (now or in the future) may be available via subscription. Subscriptions bill in advance on a recurring basis (e.g., monthly/annually) until canceled. You can cancel via your account settings; access continues through the current paid period. If a payment fails, we may suspend access until payment is completed.

7. Trials & Promotions (If Offered)

Free trials, promotional credits, or lifetime/limited-time offers (LTDs) may be offered at our discretion and are subject to specific terms communicated at the time of the offer. We may modify or terminate promotional offers at any time.

8. Call Quality & Availability

We strive for high-quality calling but do not guarantee uninterrupted service. Quality and availability depend on factors beyond our control (e.g., your internet connection, carrier networks, regional restrictions). We are not liable for interruptions or degradation outside our reasonable control.

9. Emergency Calling

Dialo is not a replacement for traditional phone service and does not support emergency calls (e.g., 911, 112, 999). Use a traditional telephone service to contact emergency services.

10. Privacy & Call Data

Your use of Dialo is governed by our Privacy Policy. We store call metadata (e.g., numbers dialed, timestamps, durations) for billing, troubleshooting, and compliance. Unless explicitly stated, we do not record or store call audio content. See our Privacy Policy for details on retention, security, and your rights.

11. Intellectual Property

The service, software, UI, and content (excluding user-provided content) are owned by Dialo or its licensors and are protected by applicable IP laws. You may not copy, modify, reverse engineer, or create derivative works without prior written consent.

12. Third-Party Services

To complete calls and process payments, we rely on carriers and payment processors. Your use of those services may be subject to their terms. We are not responsible for third-party services we do not control.

13. Suspension & Termination

We may suspend or terminate your account (with or without notice) for breach of these Terms, suspected fraud/abuse, or legal/compliance reasons. Upon termination, your right to use the service ends immediately. Prepaid, unused credits are non-refundable unless required by law.

14. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRATA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRATA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNTS YOU PAID TO TRATA FOR THE SERVICE IN THE 3 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS OF LIABILITY; IN SUCH CASES, THE ABOVE LIMITATIONS APPLY TO THE FULLEST EXTENT PERMITTED.

16. Indemnification

You agree to indemnify and hold harmless Dialo and its affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the service, your breach of these Terms, or your violation of any law or third-party rights.

17. Governing Law

These Terms are governed by the laws of the State of Delaware, excluding its conflict-of-laws rules. If any provision is held invalid, the remaining provisions remain in full force and effect. These Terms constitute the entire agreement between you and Dialo regarding the service.

18. Changes to the Service or Terms

We may modify or discontinue features at any time. We may update these Terms from time to time. Material changes will be posted to this page and, when appropriate, notified to active users. Continued use after changes become effective constitutes acceptance of the updated Terms.
